Hosky Communications, Inc. d/b/a FedInsider (hereinafter “FedInsider”) has created this Privacy Policy (“Policy”) to inform you of its collection, use, storage and disclosure practices regarding Personal Information (defined below) that it collects through the www.fedinsider.com website (the “Website”). This Policy does not apply to any other information we collect through other channels, such as information that we collect offline, from other websites, or from emails you send us. FedInsider also automatically tracks certain information based on your behavior while accessing the Website and uses this information to conduct internal research on FedInsider’s users’ demographics, interests, and behavior. FedInsider may also collect your Personal Information, including your credit card or debit card information. If you permit the Website to access location services on your mobile device, FedInsider may also collect the precise location of your device when the Website are running in either the foreground or background of your mobile device.

If you connect to the Website using Facebook®, LinkedIn®, Twitter®, Google®, or another social networking site (each, a “Social Networking Site”), we will receive information that you authorize the Social Networking Site to share with us, which may include public profile information, birthday, current city, employment information, school, and email address. When we receive this information, it becomes FedInsider’s account information for purposes of your use of the Website. This information also constitutes Personal Information. Any information that we collect from your Social Networking Site account may depend on the privacy settings you have set with the Social Networking Site, so please consult the Social Networking Site’s privacy and data practices. If you come to the Website through a Social Networking Site, from another website, or from a device that enables third parties to collect information from or about you, you acknowledge that FedInsider has no control over the information such third-parties collect about you and any such collection or use practices are not subject to this Policy.

Personal Information will be collected and used by FedInsider to provide you with recommendations for webinars, seminars, summits, podcasts, training, continuing education, briefings, newsletters, and other content that you may be interested in, to customize the Website to provide a better user experience, and to enhance or maintain Website security. By using the Website, you agree that FedInsider may use your Personal Information to contact you and deliver information to you that, in some cases, is targeted to your interests (such as relevant webinars, seminars, summits, podcasts, trainings, briefings, newsletters, and educational or other career development related content), or provide administrative notices or communications applicable to your use of the Website. By accessing the Website, you expressly agree to receive this information via email, text, or by any other mode of communication authorized or provided by you. If you do not wish to receive these communications, we encourage you to opt out of any further receipt by following the opt out procedures set forth in each such communication.

FedInsider may disclose your Personal Information to its webinar, seminar, summit, podcast, training, continuing education, briefing, newsletter, and other content partners and/or sponsors as we determine in our sole and absolute discretion. Personal Information may also be disclosed to third parties in order to evaluate a possible business transaction such as a merger or sale of the company; provided, however, that the recipient of Personal Information will be required to maintain such Personal Information in confidence. By using the Website, you hereby authorize such use of your Personal Information as described in this section.

FedInsider does not sell your Personal Information to anyone for any reason if you have indicated a desire for FedInsider to keep the information private. However, as noted above, you acknowledge that FedInsider has contractual relationships with certain content partners and/or sponsors and FedInsider may share your Personal Information with such partners and/or sponsors as part of a contractual arrangement. You acknowledge that FedInsider has no control over how your Personal Information is used by the third-parties in which it may share your Personal Information and you acknowledge that FedInsider has no responsibility or obligation to you regarding the use or sale of your Personal Information by these third-parties or the privacy practices of such third-parties.

FedInsider may also disclose specific Personal Information when we determine that such disclosure is necessary to comply with the law, to cooperate with or seek assistance from law enforcement, or to protect the interests or safety of FedInsider or other users of the Website.

FedInsider collects and stores Personal Information that you provide through the Website on its data-hosting platform. FedInsider reserves the right to retain your Personal Information indefinitely except where prohibited by federal, state, or local law.

However, understand that the Internet is not a completely secure medium of communication. Therefore, although FedInsider is committed to protecting your privacy, FedInsider cannot and does not guarantee, and you should not expect, that your Personal Information or private communications will always remain private. To protect your privacy, please do not use the Website to communicate information that you want kept confidential. FedInsider will not be responsible for any damages that you or others may suffer as a result of the loss of confidentiality of any such information. Every user of the Website is entitled to the following: (i) the right to request copies of your Personal Information, (ii) the right to request that FedInsider correct any information that you believe is inaccurate or incomplete; (iii) the right to request that FedInsider erase your Personal Information; (iv) the right to request FedInsider restrict its processing of your Personal Information; (v) the right to request that FedInsider transfer your Personal Information to another organization or directly to you. FedInsider provides you the opportunity to opt-out of receiving marketing communications from FedInsider and/or FedInsider partners and sponsors and gives you the option to remove your information from FedInsider’s database, and to not receive future marketing communications.

If FedInsider processes your Personal Information in reliance upon your consent, you can contact FedInsider at any time to withdraw your consent.

FedInsider will respond to such requests in accordance with the requirements of applicable data protection laws. Please note that to fulfill your request, FedInsider may need you to provide certain information to verify your identity. Depending upon applicable data protection and privacy law, individuals may also designate an authorized agent to exercise these rights on their behalf.

FedInsider reserves the right, in its sole discretion, to update, change, modify, add, or remove portions of this Policy from time to time without notice. No amendment, modification, extension, limitation, waiver or termination of this Policy by you shall be valid except with the written consent of FedInsider. We encourage you to periodically review this page for the latest information on FedInsider’s privacy practices. Your continued use of the Website is subject to the most current effective version of this Policy. If you object to the Policy after it becomes effective, you may no longer use the Website.

By using the Website, you hereby agree to release and hold harmless Hosky Communications, Inc., and its owners, stockholders, directors, officers, agents, representatives, employees, contractors, successors, and assigns from any and all loss, damage, expense or cost (including attorneys’ fees and disbursements attendant thereto) arising out of or in any way connected with FedInsider’s: (i) collection, use, processing, maintenance, storage, retention, sharing, disposal or disclosure of your Personal Information, including, without limitation, due to the act, omission, breach, negligence, willful misconduct, or other failure by a FedInsider partner, sponsor, or any other third-party vendor engaged by FedInsider; or (ii) mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance including any claims you might have under laws protecting intellectual property and personal privacy.

By using the Website, you agree to promptly notify FedInsider in writing of any disputes or claims arising out of or relating to the Website or the Personal Information that is collected, processed, stored, retained, shared, or disposed of by FedInsider. and agree, for a period of thirty (30) days from the date FedInsider receives notice of your dispute or claim, to work with FedInsider in good faith to promptly resolve such dispute or claim on reasonable terms. To the extent you and FedInsider are unable to resolve the dispute or claim within such thirty (30) day period, you and FedInsider hereby agree that such dispute shall be submitted to a neutral third-party mediator located in the District of Columbia, mutually agreed upon by the parties, before the commencement of any legal action, provided that, in the event you and FedInsider are unable to agree upon a third-party mediator, then the parties agree that the dispute or claim shall be submitted to JAMS, and JAMS shall choose a mediator located in the District of Columbia, who will oversee the mediation. The parties further agree that any mediation contemplated hereunder shall be held at a location exclusively in the District of Columbia.

FedInsider is designed and intended to be used by adults and does not knowingly collect information from children under the age of 13. No part of the Website is designed to attract children under the age of 13. Anyone under the age of 13 is not permitted to use the Website or provide Personal Information to FedInsider.

If any term or provision of this Policy shall to any extent be deemed invalid or unenforceable by a court of competent jurisdiction, the remainder of this Policy shall be unaffected thereby, and each term and provision of this Policy shall be enforced to the fullest extent permitted by law.

This Policy and its validity, construction, enforcement, and interpretation shall be governed by the laws of the District of Columbia, without reference to choose of law rules. You agree that any action concerning the terms of this Policy, which are not resolved through the dispute resolution procedure set forth above, shall be brought exclusively in the Superior Court of the District of Columbia, USA and you agree to accept service of process pursuant to the District of Columbia Rules and procedures.

YOU HEREBY EXPRESSLY WAIVE ANY RIGHT TO TRIAL BY JURY FOR ANY DISPUTES ARISING OUT OF OR OTHERWISE RELATED TO THIS POLICY OR YOUR USE OF THE WEBSITE.
